A rental deposit guarantee can replace an agreed cash deposit, but its value depends on the actual promise behind the document. This guide helps landlords in Germany check the amount, coverage and claim procedure before accepting it.

Start with the security agreed in the tenancy
A prospective tenant wants to keep savings available for moving and offers a rental deposit guarantee. This can be a workable arrangement. Instead of money held as a deposit, however, you receive a promise from another party to meet specified obligations. The useful question is whether this particular promise provides the security agreed for this particular home, with a payment procedure you can actually use.
This guide concerns residential property in Germany, including Düsseldorf and North Rhine-Westphalia. German law applies throughout; English terminology does not import British or American deposit rules. A deposit obligation normally depends on an agreement. Begin by reading the tenancy draft: does it require cash, permit a bank guarantee, or allow the tenant to choose between specified forms? An existing contractual choice cannot simply be removed by announcing that you now prefer cash.
Where cash has been agreed, the tenant generally cannot substitute an insurance document unilaterally. You can agree to a change after assessing the proposed guarantee. Record the arrangement clearly, including which security is being replaced. An application, a preliminary acceptance and an effective guarantee are separate stages. A reassuring confirmation that an application has been received is not necessarily security you can claim against.
Deal with the question before the planned start of the tenancy. Identify the missing documents, who will obtain them and when the review will be completed. Last-minute discussion at the key handover makes mistakes more likely. At the same time, preserve the tenant's statutory instalment rights where the agreement requires a money deposit; a preference for immediate security does not cancel those rights.
Identify the party that actually owes the guarantee
Under section 765 BGB, a guarantor undertakes to the creditor to answer for another person's obligation. In this setting, the landlord is normally the creditor, the tenant owes the secured obligations and the guarantor promises to meet them within the guarantee. A website or intermediary may arrange the product without becoming the party liable to you. Check the guarantor's full legal identity rather than relying on a trading name.
A bank guarantee is issued by a bank. An insurance-based rental deposit arrangement uses an insurer as guarantor. The tenant usually pays a charge under a separate agreement for providing that security; those payments do not build up a cash deposit in your hands. A private guarantee, for example from a parent, relies on an individual instead. Its practical value also depends on that person's ability to meet a valid demand.
The expression deposit insurance can be misleading. It does not generally discharge the tenant's justified rent or damage liabilities. To the extent that the guarantor satisfies the creditor, the claim generally passes to the guarantor under section 774 BGB. Contractual reimbursement provisions may also apply. The arrangement should not be treated as unlimited insurance against every future rental loss.
Assess the applicant and the proposed security separately. Preserving money for a move does not establish that someone is unreliable, while a guarantor's approval does not replace your own suitable tenant selection. Obtain only information needed for the actual decision. Our guide to finding suitable tenants places that decision within the wider letting process.
Apply one combined security limit
For ordinary residential security, section 551 BGB sets a ceiling of three monthly rents excluding operating costs separately stated as an advance or flat charge. Calculate the total security required. Splitting it between cash and a guarantee, or using several documents, does not create a separate allowance for each. This ceiling concerns the security; it does not automatically cap an otherwise valid claim for damage.
Consider a German tenancy with monthly basic rent of €900 and operating-cost advances of €250. The ordinary security ceiling is €2,700. An agreed combination of €900 cash and a guarantee for €1,800 fits within that amount. Requiring €2,700 cash plus an additional €900 guarantee does not. The €250 operating-cost advance is excluded from the calculation. If the starting rent itself needs review, use the separate guide to calculating the rent.
Where the security consists of money, the tenant can pay three equal monthly instalments. The first is due at the beginning of the tenancy, with the next two due alongside the immediately following rent payments. That statutory right does not generally allow a guarantee document to be supplied in three instalments. See paying a rental deposit in instalments for the cash arrangement. Cash investment duties likewise concern money actually provided.
There are distinct exceptions involving third-party security. In case VIII ZR 379/12, the Federal Court of Justice addressed security intended to avert termination for payment default and referred to unsolicited parental guarantees. These situations do not justify routinely requiring additional parental security at the start of every tenancy. Have a German tenancy lawyer assess the circumstances, any genuine voluntary offer and the burden on the tenant before relying on an exception. Merely labelling a document voluntary settles none of those questions.
Read the complete document before saying yes
Obtain the guarantee wording and all applicable conditions. A brochure promising security of up to three months' rent does not establish your actual rights. Match the landlord, tenant, exact property, tenancy reference and maximum amount against the lease. With joint tenants, check whose obligations are secured. A document naming only a former tenant may fail to provide the protection you expected even though the address is correct.
Read the scope of the promise next. Does it secure rent alone, or also valid damage claims and operating-cost balances? Are particular periods or types of claim excluded? Do interest and enforcement costs use up the stated maximum? A guarantee for €2,700 may have the right face value but a narrower purpose than the tenancy requires. Ask the issuer to explain ambiguity and correct inaccurate details before acceptance.
Form is another separate issue. Section 766 BGB generally requires a written guarantee declaration and excludes electronic form. Do not assume that an ordinary email or a scan from a private parent provides the legally required declaration. Section 350 HGB provides an exception where giving the guarantee is a commercial transaction on the guarantor's side. Professionally issued digital guarantees are therefore not automatically invalid.
Verify authenticity and current status with the real issuer through independently obtained contact details. An application number alone does not demonstrate that liability has begun. Keep the operative document and conditions together, with any later amendments. A managing agent who handles a claim several years later should be able to identify the effective version without reconstructing a chain of incomplete messages.
Understand what triggers payment
An ordinary guarantor can generally raise the defence known as Einrede der Vorausklage. Under section 771 BGB, that allows refusal of payment until enforcement against the principal debtor has been attempted unsuccessfully, subject to applicable exceptions. Where giving the guarantee is a commercial transaction for the guarantor, section 349 HGB already excludes this defence. From a landlord's perspective, this can add considerable time and work before money becomes available.
A selbstschuldnerisch guarantee removes that particular defence under section 773 BGB. You do not have to attempt enforcement against the tenant first merely for that reason. Other conditions remain relevant. Section 768 BGB generally permits the guarantor to invoke defences available to the tenant. The underlying claim must still be considered, including whether it is due and within the agreed security purpose.
A guarantee payable on first demand, or auf erstes Anfordern, is different. It can provide for payment before objections have been finally resolved, moving a dispute into later recovery proceedings. It does not authorise invented claims or payment demands known to be unjustified. A faster payment mechanism creates no additional right to compensation. The wording, the surrounding agreement and the validity of any clause still matter; obtain legal review where these are unclear.
Before accepting, work through a realistic situation with the issuer: two months' rent remain unpaid. Where is the demand sent, which form must be used, and which supporting documents are needed? Is the tenant notified and allowed to respond? Do not promise yourself a fixed payment date based on marketing language. The complete terms, rather than a general description of fast processing, determine the relevant procedure.
Compare duration and the amount left after a claim
Two guarantees can show the same amount while offering quite different practical protection. One may cover the agreed liabilities until properly released. Another may expire on a specified date or secure only a narrower category of claims. Check whether liabilities assessed after the tenant leaves can still fall within the guarantee and whether they must be notified within a particular contractual period.
Distinguish the tenant's agreement with the provider from the guarantor's obligation to you. Cancellation or unpaid charges under the first agreement do not necessarily extinguish an already issued guarantee. Nor should you assume that such events can never affect it. Ask the issuer to identify which events alter your security and how you would be notified. Keep the answer with the relevant contract wording.
The remaining amount also matters. Suppose a €2,700 guarantee expressly provides that payments reduce the aggregate maximum. After a valid payment of €2,300, only €400 remains. The original maximum does not automatically become available again each month. Whether security can or must be replenished needs a separate assessment of the agreements and applicable law.
Your acceptance decision should therefore cover the permitted amount, the secured obligations, the guarantor's reliability, the practical payment route and the relevant duration. Request a precise correction where one detail is missing. Where the offered arrangement does not match the tenancy, discuss the agreed alternative with the tenant. Neither a familiar brand nor a low fee paid by the tenant answers these substantive questions.
Prepare evidence for a justified demand
A guarantee does not remove the need to document the tenancy. Maintain an intelligible rent account and record the property's condition at move-in and return. A damage claim needs an identifiable change, a basis for the tenant's responsibility and a justified amount. Under section 538 BGB, the tenant is not responsible for deterioration resulting from use in accordance with the contract.
In our example, assume justified rent arrears of €1,800 and a justified damage claim of €500. If both are covered and the payment requirements are met, the demand is €2,300. Set out each item separately. The €2,700 face value is not a lump sum you may automatically collect. If the tenant pays part of the debt meanwhile, adjust the demand; the same claim must not be satisfied twice.
Check statutory time limits alongside any provider notification rules. Section 548 BGB generally gives a six-month limitation period for a landlord's compensation claims concerning changes to or deterioration of the property, running from recovery of possession. This is neither a universal period for every tenancy debt nor a mandatory waiting period before releasing security. Do not assume that writing to the guarantor alone preserves all rights against limitation.
If deductions are disputed, limitation is approaching or the right to demand payment is unclear, a lawyer practising German tenancy law should review the claim and proposed action. Keep an orderly account of correspondence and payments. A prompt, documented calculation gives both parties a better basis for resolving the matter than demanding the entire guarantee without an explanation.
Agree the exchange and eventual release
If a guarantee is to replace an existing cash deposit, arrange an explicit exchange. First verify the proposed guarantee and when it takes effect. Then agree the return and accounting for the former security. Aim for continuous lawful cover, without releasing cash on the strength of an application receipt or keeping a full cash deposit and full replacement guarantee indefinitely.
After the tenancy ends, establish which secured claims remain justified or reasonably outstanding. The time needed for inspection and accounting depends on the circumstances. An outstanding operating-cost statement does not automatically justify retaining every guarantee in full regardless of the likely balance. Where appropriate, clarify an adequately limited partial release with the guarantor. Do not sign an unconditional waiver while you still need the security for valid outstanding claims.
Returning a paper document, issuing a digital release and ending the tenant's provider charges may follow different rules. Read what each declaration actually does, obtain confirmation of receipt and retain the final account. It should be clear whether liability has ended completely or has only been reduced by a stated amount.
If you are preparing to let a home in Düsseldorf or NRW, use the landlord enquiry form to describe the property, intended start date and current stage of the letting. These details provide a concrete basis for discussing the letting process. An appropriate law firm should assess unusual guarantee clauses; the guarantor should answer questions about its document and conditions. Acceptance becomes a reasoned decision when the tenancy, the security and the later claim process fit together.
