Letting a flat as a shared home: contracts and tenant changes

Compare three ways to let a shared flat in Germany, including joint liability, deposits, empty rooms and changes of residents. A practical guide for NRW landlords.

A shared flat can work well when the contract matches the way its residents will live. Before advertising, decide who owes the rent, who carries the cost of an empty room and how someone can leave. This guide applies German law, including to properties in NRW.

Planning to let a property in Düsseldorf or NRW? Discuss your letting

Start with the responsibilities you want to retain

In Germany, a shared household is often called a Wohngemeinschaft, or WG. The term describes a living arrangement, rather than one particular tenancy contract. An owner can let the whole flat jointly to several people, let it to one main tenant who sublets rooms, or grant separate tenancies for individual rooms. These choices distribute responsibility differently, even when the people and the layout are exactly the same.

First check whether the flat supports the intended everyday use. Each proposed bedroom should offer the privacy advertised. A room reached only through someone else’s bedroom is different from an independently accessible room. Consider bathroom capacity, kitchen storage, noise and space for belongings. If alterations or the permitted use are unclear, obtain advice from the appropriate building professional or local building authority before promising a particular arrangement.

Then assess your capacity to manage it. Separate room contracts can involve several payment records, different leaving dates and repeated viewings. A joint group may organise much of its own household, but changes to the contractual tenants still require attention. One main tenant provides a central contact while concentrating the owner’s contractual payment risk on that person.

The examples below use a Düsseldorf flat with three independently accessible rooms. Anna, Ben and Cem want to move in. Assume a monthly basic rent of €1,200 plus €300 in operating-cost advances. These are illustrative figures, not an assessment of market rent or a claim that this price is legally permissible for a particular property. The first decision is whether you want to offer one shared tenancy or three separately managed rental opportunities.

A joint tenancy makes the group jointly responsible

If Anna, Ben and Cem all sign as tenants, they become parties to one tenancy for the whole flat. Identify each person clearly in the agreement. A household nickname is not a reliable substitute for naming the contracting parties. Someone nominated to coordinate repairs or payments does not automatically have authority to make every legally binding declaration for everyone else.

Under the German rules on joint obligations, the tenants generally have joint and several liability. The landlord can recover the debt only once, but may seek the outstanding contractual payment from an individual joint debtor. The relevant provisions are section 421 BGB and section 427 BGB. An internal agreement to contribute €500 each towards the €1,500 monthly payment does not itself limit the landlord’s claim to €500 per person.

Suppose Ben fails to pay his share. The contractual total is still due, even though Anna and Cem have paid their own agreed contributions. Any reimbursement between residents is a separate matter from the owner’s claim. Keep a clear payment record so that several transfers are allocated to the same tenancy and an apparent missing payment is not simply an accounting error.

This model suits a group prepared to take collective responsibility for the flat. It does not make tenant selection unnecessary, and three signatures do not guarantee that the rent is affordable. Explain the consequences of leaving at the beginning: Ben remains a contractual tenant unless he is validly released or the tenancy ends. Moving belongings out, returning a key or changing an official address does not, by itself, amend the rental contract.

One main tenant creates a separate subletting relationship

Alternatively, Anna alone can rent the flat from you and grant subtenancies to Ben and Cem. Your contract is with Anna. Their room agreements are with her. The subtenants do not automatically become your tenants simply because you know they live in the property or have approved their occupation.

Anna remains responsible for the rent under the main tenancy. If Ben leaves and his room stays empty, that vacancy does not automatically reduce the amount she owes you. This can simplify the owner’s administration, but only if Anna understands the role and can carry it financially. Choosing a main tenant merely because one person happened to organise the viewing can create an arrangement nobody intended.

Document the permitted subletting arrangement: rooms, intended occupancy and how proposed new subtenants will be notified or approved. Section 540 BGB generally requires permission for allowing a third party to use the rented property. Permission also does not remove the tenant’s responsibility under that provision for a third party’s culpable conduct when using it.

A later legitimate interest can give a residential tenant a right to permission to sublet part of the home, subject to the conditions and limits in section 553 BGB. Overcrowding or an important objection concerning the proposed person can matter. Passing on the whole flat is a different issue. Do not use a blanket clause as a substitute for examining the actual request.

Plan for Anna’s eventual departure too. Ben does not inherit her main tenancy automatically. A proposed transfer and the consequences for existing subtenancies need an agreed solution. A main tenant’s notice is therefore a reason to review the entire arrangement promptly, rather than assume that the remaining occupants can simply continue under unchanged contractual roles.

Separate room contracts give you direct control and vacancy exposure

With individual room tenancies, each resident rents a specified room from you and receives defined rights to use shared spaces. Identify the room by location or number and describe the kitchen, bathroom and other shared facilities. A floor plan helps prevent uncertainty about which space is exclusive and which equipment belongs to the letting.

For illustration, each room might carry €400 basic rent and €100 in operating-cost advances. Equal prices are used only to keep the calculation simple; room size and facilities may justify different amounts. If Ben’s tenancy ends validly and his room remains vacant for a month, you lose €400 in basic rent in this example. Anna and Cem do not become responsible for that missing rent merely because they share the bathroom.

The owner normally arranges the next letting, while respecting the rights already granted to the remaining residents. Agree how viewings will work and which spaces prospective tenants may see. Possessing a building key does not create a general right to enter let rooms unannounced. Good appointment planning helps the new letting without turning the occupied flat into a permanently open viewing venue.

Ordinary residential protections do not disappear simply because the accommodation is a room, contains furniture or is occupied by a student. German law contains specific exceptions, including certain furnished accommodation within the landlord’s own home, but their requirements must actually be met. A separate investment flat occupied by a WG should not be managed using an owner-occupied-room exception without checking its applicability under section 549 BGB.

Align rent, running costs and security with the contract

Assess the expected return after realistic vacancy and management costs. The sum of three advertised room rents is not automatically a dependable net income. Include furnishing and replacement costs where relevant, and check the rent rules that apply at the property’s location. Dividing a flat into room contracts does not provide a general exemption from residential rent restrictions. Our guide to calculating rental prices helps organise that assessment.

Keep basic rent, operating-cost advances and separately arranged services distinct. Under section 556 BGB, operating-cost advances generally require annual accounts. A flat-rate agreement does not simply override mandatory heating-cost rules. With room contracts, decide how shared areas, occupancy periods and any relevant consumption will be treated. An unclear allocation method can create more disputes than the apparent convenience of one inclusive figure resolves.

Section 551 BGB generally limits agreed security to three months’ rent excluding separately stated operating costs. Our joint tenancy therefore has a ceiling of €3,600 in total, rather than €3,600 for each joint tenant. Three separate contracts at €400 basic rent each would each have a €1,200 ceiling. A cash deposit may be paid in three monthly instalments and must be invested separately from the landlord’s assets.

Record which payment secures which contract. Ben may have contributed a third of the joint deposit internally, but his departure does not automatically create a separate repayment entitlement against the owner. Deal with outgoing and incoming tenants’ deposit interests as part of the change. Avoid releasing security or accepting extra guarantees without checking how the arrangements fit together and whether the legal limits are respected.

Treat a resident change as a decision about contractual parties

The Federal Court of Justice’s judgment of 27 April 2022, VIII ZR 304/21, rejects an automatic replacement right based only on joint WG occupation. The agreement and its interpretation matter. A shared understanding that frequent changes were intended may be relevant, so an absolute statement that landlords can always refuse is also misleading.

Assume Ben wishes to leave on 30 November and Dana wishes to enter on 1 December. Establish whether the proposal is to replace Ben as a contractual tenant or to let Dana occupy through a subtenancy. These are different outcomes. For an agreed replacement in a joint tenancy, involve the landlord, outgoing and remaining tenants, and incoming tenant in a clear written addendum.

Specify the effective date and deal expressly with liabilities from earlier periods. Are there rent arrears, outstanding operating-cost accounts or recorded damage? Releasing Ben from future obligations is different from waiving an existing debt. Dana should not be presented with an unexplained provision accepting every unknown historic liability. Obtain tenancy-law advice for wording that changes responsibility for old claims.

Take an interim record of the room, shared equipment and keys. This helps establish condition but is not itself a release from the tenancy. Agree when Dana starts paying and how deposit interests are handled. If Dana pays Ben directly, record what that payment settles. Without this explanation, the same sum can later be described as a furniture purchase, a deposit contribution or reimbursement of rent by different people.

Give everyone the completed agreement and update the contractual contact record. An orderly handover protects continuity: the flat can remain occupied while each person knows exactly when their role starts or ends. A name change in the owner’s address book is not sufficient evidence of that agreement.

Keep damage, household disagreements and termination separate

Normal wear is not automatically a compensation claim. Section 538 BGB distinguishes deterioration through contractual use from matters for which a tenant is responsible. When damage is reported, identify the item, the observed condition and the available evidence of its earlier state. Photographs should focus on the property rather than collecting unnecessary images of residents’ personal possessions.

If the kitchen is damaged and nobody knows who caused it, three separate room contracts do not justify automatically dividing a bill into thirds. Liability needs a proper basis. Equally, joint liability for rent under a shared contract does not validate every alleged damage claim. A technical defect may instead call for the landlord’s maintenance obligation under section 535 BGB to be examined.

Clear arrangements for shared spaces, waste and reporting faults make daily management easier. A household cleaning rota and a contractual maintenance obligation are different things. Keep a practical contact route for genuine defects, while avoiding promises to decide every disagreement about how residents share chores or use the fridge.

Termination also follows the contractual structure. Joint tenants generally terminate their shared tenancy together; one person’s individual notice normally does not release only that person. Separate room tenancies can end individually. Section 568 BGB requires written form for residential tenancy termination; an ordinary group-chat message is insufficient. Section 573c BGB governs the usual tenant notice period for an ordinary indefinite residential tenancy. Check any special term, restriction or proposed landlord termination against the actual agreement before confirming a binding leaving date.

Prepare a letting offer that matches everyday reality

Before marketing, put the essentials on one page: chosen contract model, rented space, parties, rent, security, shared facilities and approach to replacements. Add the furniture included and who arranges electricity and internet. An advertisement for an individual room should not conceal a later requirement to take responsibility for the entire flat’s rent under a joint tenancy.

Collect applicant information in stages. A viewing does not generally justify routinely requesting salary documents and credit reports. Further necessary questions become appropriate when there is a concrete intention to rent; income evidence and targeted credit checks generally belong to the already selected preferred applicant. The German Data Protection Conference’s January 2026 guidance explains these stages. Our guide to finding tenants develops the practical selection process.

Check the proposed contract rather than trusting a template labelled “WG”. Clauses about replacements, security, liability and duration must fit the chosen model. An expected graduation date alone is not a valid reason for a fixed term under section 575 BGB. Read the general tenancy agreement guide for context, and use a lawyer specialising in German tenancy law where the actual legal drafting needs attention.

To discuss preparing your flat for letting, use the landlord enquiry form. Describe its location, layout, furnishings and intended availability, and say whether you already have a group or wish to market rooms separately. This gives the discussion a useful starting point: an offer suited to the property, your management capacity and the contractual arrangement you want to establish.

Frequently asked questions

Can a resident appoint a replacement tenant?

Moving out does not automatically release a joint tenant. Replacing a contractual tenant generally requires agreement involving the existing parties and the incoming person. Whether the landlord must agree depends on the contract and its interpretation; describing the home as a WG does not by itself create a general right to replacement.

Is every resident liable for all the rent?

Joint tenants generally bear joint and several liability for the rent owed under their shared contract. Separate room tenants owe the rent under their individual contracts. With a main tenant and subtenants, the main tenant remains responsible to the owner for the rent under the main tenancy.

Does a resident leaving mean the deposit must be repaid?

A change of residents does not necessarily end the tenancy. For a joint contract, the parties should settle deposit rights alongside the outgoing tenant’s release and the new tenant’s entry. An ended room tenancy needs its own deposit assessment; handing back keys alone does not establish an immediate right to full repayment.
