Selling a house with an outstanding mortgage in Germany

Selling while a mortgage remains: clarify the redemption balance, early repayment charge, land charge and net proceeds before the notarial appointment.

An outstanding property loan does not automatically prevent a sale. What matters is how the financing will be repaid or otherwise resolved and whether the purchase price will cover it. Coordinate the lender, sale process and notary early instead of checking the true redemption amount after agreeing a price.

Establish the figures before deciding on price

Ask your bank for redemption information for a specific proposed date. The current loan balance is not necessarily a binding payoff amount. Relevant items include principal, accrued interest, any early repayment compensation and other costs that actually apply.

List sale expenses and possible tax separately. Review each loan if there is more than one. Additional security or financing secured across several properties can also affect the process. A high sale price does not necessarily mean equally high cash proceeds available to you.

When can early repayment compensation arise?

Repayment during a fixed-rate period can trigger compensation under the applicable legal and contractual conditions. Section 490 BGB addresses termination for a legitimate interest among other matters. Whether an amount is due and how much requires examination of the particular agreement and repayment circumstances.

The frequently quoted 1% and 0.5% limits in section 502 BGB cannot simply be applied to consumer real-estate loans. Seek a review of a calculation you cannot understand. Base pricing decisions on written lender information instead of a general online calculator.

Understand the ten-year termination right

For fixed borrowing rates, section 489 BGB generally permits termination after ten years from full receipt of the loan, subject to six months’ notice. The relevant date is therefore not automatically the house purchase or the signature of the loan agreement.

Later agreements concerning the borrowing rate or repayment period can change the relevant starting point. Check disbursement dates, amendments and notice periods before relying on a particular repayment date. This is not a general promise that every sale becomes cost-free after ten calendar years.

Distinguish the loan from the registered land charge

The German land charge, or Grundschuld, is security. Its registered amount need not equal the outstanding loan and it does not disappear automatically once the loan is repaid. Our guide to the land register and land charge explains the distinction.

During a sale, the notary coordinates the agreed release of encumbrances with the banks. Part of the price may be paid directly to the lender under the relevant payment instructions. Do not assume that the buyer takes over your loan: loan assumption or substitution of security requires separate assessment and consent.

Illustration: what remains from the price?

Suppose the price is €420,000, the principal to be repaid is €250,000 and an assumed compensation charge is €8,000. The initial arithmetic remainder is €162,000. Further sale costs, interest until payment and any tax still need to be deducted. These figures illustrate the calculation; they are not an estimate for your contract.

If proceeds are insufficient for redemption, resolve the funding gap with the bank before a binding sale process. The tax assessment under section 23 EStG has its own conditions and exemptions. An outstanding mortgage does not determine that result.

A practical sequence before signing

  1. Collect loan agreements, amendments, disbursement dates and land-register records.
  2. Request lender redemption information for a realistic payment date.
  3. Calculate market value, sale costs and available proceeds separately.
  4. Resolve open financing questions and any shortfall.
  5. Prepare the documents required by the notary.

For an initial sale enquiry in Düsseldorf or NRW, provide property type, postcode and timeframe. Do not paste private loan documents into an open enquiry field; the required information can be coordinated in the next step.

Frequently asked questions

Can I sell during the fixed-rate period?

A sale is generally possible. Redemption, possible compensation and release of security need to be agreed with the lender and coordinated with the notary.

Does the buyer automatically continue my loan?

No. A property purchase does not automatically transfer the seller’s loan. That requires a separate agreement and the necessary lender consent.

Is the registered land charge my current debt?

No. It secures claims; the actual outstanding loan balance follows from the financing agreement and the bank’s information.
